Civil Litigation
Winston-Salem Civil Litigation Attorneys

Overview:
The firm represents individuals and businesses in all types of civil disputes and litigation. We assist our clients in dispute resolution through negotiation, mediation, and arbitration. When necessary and appropriate, we represent our clients, as plaintiffs or defendants, in state and federal trial and appellate courts.

We work closely with our clients to establish a strategy and timetable for resolving the dispute or litigation. We tailor our fee agreements to match the circumstances of each particular case, and we insure that each case is staffed and managed at an appropriate personnel and cost level.

Personal Injury and Malpractice:
We handle cases involving motor vehicle accidents, products liability, and premises liability. We also represent clients prosecuting and defending claims of professional malpractice in the fields of medicine, dentistry, and law.

Railroad:
We represent and advise two railroads that operate in central North Carolina on all claims for: personal injury and property damage under state or federal law and regulations; easements and other property rights; contracts; collective bargaining disputes; and other related matters.

Land and Construction:
We represent clients in land disputes, such as agreements to convey land, deeds given under alleged undue influence or insufficient mental capacity, and trespass. We handle construction and remodeling disputes, both for the owner buyer and the contractor seller.

Contracts and Business:
We help individuals and businesses resolve a wide range of contract and business related disputes, including claims involving breach of contract, covenants not to compete, fraud, and unfair and deceptive trade practices. We also handle employment matters for both employees and employers.

Fiduciaries and Estates:
The firm’s extensive estate planning and estate administration and elder law practice leads us to help our clients in disputes and suits involving the appointment and removal of personal representatives, breach of duty by fiduciaries such as attorneys-in-fact and personal representatives, caveats, incompetency proceedings, and the appointment of guardians.

Domestic Relations:
We help our clients through difficult domestic disputes. We handle divorce, child support and custody, post-separation support and alimony, and equitable distribution. We also handle name changes and adoptions.

Collections:
The firm assists its business and individual clients in collecting unpaid debts in any amount, in and out of North Carolina. Unlike some other firms, we do not stop our efforts when we obtain a judgment for our clients; we use supplemental proceedings and every other available legal procedure to force the debtor to actually pay the amount owed.

Appeals:
We handle appeals in state and federal courts, including cases in which we did not represent the client at the trial level. All attorneys are members of the North Carolina State Bar and are admitted to practice before all North Carolina courts.
